The High Court in Bloemfontein has rejected Dr Nandipha Magudumana permission to appeal a ruling declaring her arrest lawful. The court handed down judgment on her application for leave to appeal on Tuesday.

The judge found that another court will not come to a different conclusion. Dr Magudumana had asked for permission to appeal a ruling that declared her detention in Tanzania lawful. She is charged with aiding and abetting a convicted criminal.

In his ruling, Judge Phillip Loubser said should Magudumana wish to challenge the decision on her deportation, she should approach the court in Tanzania as South African courts have no jurisdiction.

Magudumana and Bester, who has been on the run, were arrested in April, 10km out of Arusha in Tanzania. This is after fleeing the hotel they were staying in. 

They were arrested together with a Mozambican national, who was believed to have been the driver assisting them in border crossings during their escape.
