Murder trial of the late Moses Maluleke postponed to next month

The Limpopo High Court in Polokwane has postponed the murder trial of the late Collins Chabane Mayor, Moses Maluleke to 5 October 2023. This is for the full record of the court proceedings to be made available.
The court initially postponed the case in August to allow the accused number one, Shumani Nemadodzi time to secure a legal representative. His Advocate Peter Legodi withdrew from the case citing a conflict of interest between him and the accused.

Prior to that, the case was postponed after the state had requested the court to make available a full record of the transcript so that proceedings donāt get affected when the trial resumes on Thursday.
But prosecutor advocate Eric Mabapa has however requested another postponement because they only manage to get some parts of the record. He asked to be given time to get the full record.
“Accused number one was initially represented by Mr. Legodi from Legal Aid South Africa. That issue seems to be settled, My Lady. I therefore, apply that the matter be postponed and it is even a provisional date as well for the record. My Lady, we seemed to be agreeing on the 5th of October,ā he said.
MOSES MALULEKE MURDER TRIAL POSTPONED
The trial was scheduled to be concluded on 1 September 2023. But has seen several delays since it resumed in August.
Before it was adjourned last month, Legodi was making an application to get the murder charge against Nemadodzi withdrawn. This is after the police failed to prove that he is the one who pulled the trigger. As alleged by the Section 204 state witness.
When the trial hearings resume next month, it will hear from the new legal representative if she still wants to proceed with the same application.
Shumani Nemadzodzi, alongside his co-accused Isaac Mudau, Wiseman Baloyi, Pfunzo Lidzebe and Tshianeo Munyai each face six charges. They range from murder, attempted murder, robbery, and being in possession of unlawful firearms and ammunition. All the accused will remain in police custody.Ā
